Terms of Service

By accessing or using Rootkin (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

Rootkin is a private family tree and social platform that allows users to create family trees, share photos and events, and connect with family members. The Service includes all features, applications, and services provided by Rootkin.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement.

The Service allows you to post, upload, and share content, including photos, text, family information, and event details ("User Content"). You retain ownership of your User Content.

By posting User Content, you grant Rootkin a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service.

You represent and warrant that: (a) you own or have the necessary rights to post your User Content; (b) your User Content does not violate the rights of any third party; and (c) your User Content complies with these Terms and all applicable laws.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe upon the rights of others
• Post content that is defamatory, obscene, abusive, or otherwise objectionable
• Impersonate any person or entity
• Engage in unauthorised data collection or harvesting
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the Service or servers
• Use the Service for any commercial purpose without our express consent

Family trees on Rootkin are private by default. Only invited and verified members can access the content of a family tree. You are responsible for inviting only people you trust and who are genuinely connected to your family.

While we take measures to protect your data, we cannot guarantee complete security. You acknowledge that you share information at your own risk and that you should not post information you consider highly sensitive.

Rootkin may display gift suggestions and connect users with third-party vendors. Rootkin is not a seller of goods. All purchases are made directly with the vendor. Rootkin acts solely as a referral platform.

We do not guarantee the quality, safety, or legality of vendor products. Any disputes regarding purchases must be resolved directly with the vendor. Rootkin's commission on referred sales is separate from the transaction between you and the vendor.

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease, and we may delete your User Content in accordance with our Privacy Policy.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ROOTKIN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOTKIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE.

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions. Any legal action arising out of these Terms shall be brought exclusively in the courts of Zimbabwe.
